The General Terms and Conditions of Sale for VEDETTES SIRENES Sea Trips

Article 1: Reservations

Passengers must book their excursion in advance.

Any special medical conditions must be declared at the time of booking as set out in Article 6-2

Pregnant womenand people with a disability, a physical or health problem, are absolutely required to indicate this at the time of booking.

It is best to make the reservation as early as possible, given the limited number of seats on board the ship and the crowds, especially during the peak season.

The Company accepts bookings online via its website sirenes.bzh, by telephone, or directly at the point of sale.

Any reservation without immediate payment can only be validated after communication of a credit card imprint and valid contact details.

In any event, the customer shall be required to pay for the ticket following the booking under the conditions set out in Article 4 hereof.

Minors are allowed on board only if accompanied and under the responsibility of their parents.

Pets are allowed on board.

Article 2: Excursion schedules, routes and fares

The company offers its passengers several routes throughout the day, at different fares.

The schedules and routes are defined by VEDETTES SIRENES. The website as well as the leaflets, billboards and posters published by VEDETTES SIRENES which present the tours do not constitute a contractual document. The information is given as an indication. The programmes may be subject to change.

Indeed, changes to these schedules and routes may occur during the season depending on the weather, the apparent temperature, sunrise and sunset times or the opening times of establishments which can accommodate passengers on the proposed excursions (ports, restaurants, etc.).

As with timetables and itineraries, fares are subject to change at any time depending on the elements or economic conditions (surcharges, fuel…) or changes in taxes (VAT, port and customary taxes).

The prices of the services are inclusive of all taxes.

Passengers will know the timetables, routes and fares, at the time of booking via the website or after contacting the Company for an enquiry.

However, the departure and arrival times announced at the time of booking may be brought forward or delayed in the event of any difficulty encountered by the ship's captain.

In addition, weather conditions may force the ship's captain to change the originally planned tour route.

If necessary, the excursion fare will be adjusted.

In any event, passengers will be kept informed of any changes to schedules, fares or routes.

In no case shall such a change justify the payment of any compensation to passengers.

The Carrier reserves the right, at the discretion of the Captain and for reasons inherent in the navigation, to make stopovers other than those planned or to modify the original route. The captain is allowed to tow, to rescue vessels in all situations, to divert, to carry out all rescues and all transhipments. Neither the Captain nor the Company can be held responsible for diversions, changes, interruptions of services or delays in the ship's departures and arrivals, nor for the non-coincidence in the arrivals, departures or connections of ships, planes and trains.

Article 3: Cancellation

3.1- Cancellation by the Company

The company reserves the right to cancel an excursion, without notice or compensation, if the minimum passenger quota is not reached, in the event of force majeure, an act of God, bad weather, damage, malfunction of any kind, for safety reasons or any other legitimate reason.

Only the ship's captain is entitled to judge whether or not the weather conditions allow the excursion to be carried out, always with the aim of enabling passengers to enjoy a visit in the best possible conditions.

If the departure of the ship is prevented or delayed by any of these exceptional events, the company accepts no responsibility for any direct or indirect costs or damages caused to passengers.

The company undertakes to notify passengers as soon as it becomes aware of any difficulty which alters the excursion or prevents it from taking place.

The company shall endeavour to offer an alternative to the passengers and in particular, the postponement of the excursion, depending on the availability of the company, without the passengers being able to claim any compensation, refund or indemnity.

If no alternative solution is offered or accepted, passengers will be able to claim a full refund of their tickets from the Company.

Refunds are made using the same payment method which the passenger used when booking.

3.2- Passenger cancellation

The passenger has the option to cancel the booking for any reason at any time.

However, they will only be refunded or exempted from paying for their ticket if the cancellation is made at least 24 hours before the excursion departure time.

Failing this, the passenger shall be required to pay for their ticket in full and the Company shall not be liable for any refund or compensation.

3.3-Group cancellation

A group has the option of cancelling their booking for any reason at any time.

However, they shall only be refunded or exempted from paying for their ticket if the cancellation is made at least 96 hours before the departure time of the excursion.

Failing this, the passenger shall be required to pay for their ticket in full and the Company shall not be liable for any refund or compensation.

Article 4: Terms of payment

Payment for the ticket is made at the time of booking.

The company accepts payment by e-transaction, credit card, cheques, ANCV holiday vouchers or cash.

Passengers can pay for their tickets directly online on the company's website or at the main ticket office on the Port of MORGAT during opening hours.

A valid email address is required at the time of booking, in order to receive your electronic ticket. The validity of the email address is the responsibility of the customer.

Tickets are only issued against full payment.

Change is not given on holiday vouchers.

 

Article 5: Validity and non-transferability of tickets

Tickets are valid for the current season.

They are not transferable.

 

Article 6: Boarding and disembarkation

6.1- Boarding conditions

Passengers without a ticket must present themselves at the sales point 1 hour before departure. 15 minutes before in the boarding area for those with an electronic ticket.

No late passengers are accepted by the company.

In the event of lateness, even with a ticket, the passenger shall have no recourse against the company if he is not allowed to board.

The boarding and disembarkation of passengers is done in the presence of the captain, who directs his passengers and instructs them on how to board and disembark.

Only passengers who have booked their seats and present a valid ticket are entitled to board.

The ticket must be kept in good condition by the passenger for the duration of the journey.

The Company reserves the right to refuse to board a passenger or group of passengers who present themselves for boarding without a reservation or ticket.

The Captain has the authority, among others, to refuse boarding to anyone who is in a physical or mental condition which makes him unsuitable for the excursion or to anyone who has taken drugs, hallucinogens or alcohol which makes his behaviour dangerous to other passengers. In all the cases listed above, the passenger shall not be entitled to evade responsibility for damage to himself, the vessel, property and equipment, third parties and third-party property.

6.2-Health status of passengers

Any special health conditions must be declared at the time of booking.

In addition, any passenger with a disability, a proven health problem, or physical conditions incompatible with the proposed tour (pregnant woman, passenger with a back problem, person with reduced mobility or with a heavy handicap, or a high heart rate etc.) is required to inform the company at the time of booking, as indicated in article 1.

In the event of non-declaration at the time of booking, the Captain may refuse boarding to passengers whose state of health is not compatible with the excursion without the passenger being able to demand any reimbursement or compensation of any kind.

The captain is not obliged to take on board a passenger who has not mentioned his condition under these conditions.

That passenger will still be required to pay for their ticket and no refund or compensation shall be made.

Furthermore, if the captain considers that the state of health or physical condition of the passenger who has validly reported is incompatible with the trip in view of the weather conditions on the day, he is entitled to refuse boarding to the passenger.

In this case, the passenger shall be refunded in full.

6.3-Accessibility

This type of boat is incompatible with the transport of persons with reduced mobility or severe physical disabilities. In the event of non-declaration at the time of booking, the Captain has, among other things, the power to refuse boarding to passengers whose disability is not compatible with the excursion, without the passenger being able to demand any reimbursement or compensation of any kind whatsoever, as defined in Article 6.2.

Bicycles, prams, pushchairs even when folded, motorbike equipment, or other overly bulky equipment are not allowed on board and cannot be taken on board.

 

Article 7: Safety instructions and liability

The captain is the sole master on board his ship and informs the passengers of the safety instructions to be followed.

Passengers are required to remain seated in their seats while sailing.

They will only be allowed to move around the ship with the permission of the captain.

Cigarettes, including electronic ones, are not permitted on board the ship.

Minors are allowed on board if accompanied by their parents and remain under the full supervision and responsibility of their parents.

Pets are allowed on board, up to 3 per boat and a maximum weight of 25kg.

Passengers undertake in all cases to abide by the rules established by the company VEDETTES SIRENES on board the ships, as well as to follow the Captain's orders.

In the event of an accident due to passengers failing to comply with safety instructions, the Company shall not be liable for any damage which may occur.

Passengers are required to keep their personal items with them.

The company is not responsible for items on board, damage to property and personal effects (jewellery, precious metals, personal papers and documents, sound or image reproduction devices, mobile phones and glasses. In the event of the theft, loss or damage of these items, no compensation, refund or indemnity shall be made.

Article 8: Bathing

The company VEDETTES SIRENES is not a diving or snorkelling club.

However, it offers swimming breaks during its private trips.

Swimming will be carried out under the responsibility of a qualified lifeguard.

The captain reserves the right to cancel a swimming break in view of the weather conditions.

Passengers undertake in all cases to abide by the rules established by the company VEDETTES SIRENES on board the ships, as well as to follow the Captain's orders.

 

Article 9: Stopovers

The Vessel may be required to offer stopovers to its passengers during excursions.

The Company is not responsible for passengers and their personal effects during these stopovers.

No swimming equipment will be loaned during these stopovers.

The Company shall not be involved in the event of any difficulty encountered by passengers in any business or establishment during the stopover.

The captain shall provide passengers with a deadline for the end of the stopover and return to the ship.

Passengers should report to the ship 5 minutes before the departure time given by the captain.

No refund or compensation can be demanded by a passenger who has been unable to board due to lateness.

 

Article 10: Regulation of the vessel

The ships of the company VEDETTES SIRENES are subject to European regulations regarding the transport of passengers.

Navigation licence, renewed after annual inspection, attesting to the vessel's compliance with technical standards relating to the safety of passenger vessels (stability, buoyancy, strength, fire prevention and extinction, life-saving appliances…).

The captain has a Command and Chief Mechanic's Certificate.

These Certificates also attest to the possession of a first aid training certificate, and a CGO certificate (Radio Operator Certificate).

Every crew member is required to undergo an annual physical fitness check-up by a crew members' doctor.

Special insurance covers all passengers.

Article 11: Groups, Conventions and Private Trips.

11.1-Conditions

 

The reservation of a private trip or group trip shall be effective only after the acceptance by the customer of the estimate as well as after payment of a deposit equal to 50% of the total amount of the service.

The remaining amount must be paid at the latest one hour before boarding.

In the event of cancellation by the customer, the amount of the deposit remains due to the company and the customer shall not be entitled to a refund of this nor to any compensation.

In the event of cancellation by the company under the conditions described in Article 3.1the full amount shall be refunded to the customer.

 

11.2-Groups and conventions

Preferential rates for groups.

The payment of the amount shall be made in accordance with the terms and conditions defined in Article 11.1

.

For refunds, the cancellation conditions on the part of the company as defined in article 3.1. apply and the cancellation conditions on the part of the customer are defined in article 3.3

.

Within the framework of an agreement or convention established between VEDETTES SIRENES and partners, their members or clients may benefit from discounts granted by VEDETTES SIRENES.

.

At boarding, passengers will have to prove that they have stayed with or are a member of our approved partners, otherwise the amount of the ticket shall be due at the rate in force in its entirety, without any recourse to the company VEDETTES SIRENES.

The establishment of an agreement shall not allow the third-party persons and organisations signing the agreement to substitute the general sales conditions of the company VEDETTES SIRENES.

Article 12: Claims

Any claim against the company VEDETTES SIRENES must be made within 3 days of the date of the excursion, by registered letter with acknowledgement of receipt to the head office of the company S.A.R.L.. VEDETTES SIRENES 78 Bd de la France Libre, 29160 CROZON.
